Enduring Powers of Attorney Questionnaire

Interested in sorting out your Enduring Powers of Attorney? Fill out the form below and we will be in touch shortly!

Please note: this fixed fee service is for Enduring Powers of Attorney only. If you are a couple who also needs wills, our Couples Wills & Enduring Powers of Attorney package is better value.

Enduring Powers of Attorney

An Enduring Power of Attorney (EPA) lets you choose someone you trust to make decisions for you if you lose capacity through illness, accident or age. Without one, your family may need to apply to the Family Court, which can be slow and costly. Our EPA service is designed for individuals and couples who want clear documents prepared efficiently, with an in-person signing meeting.

What's included:

For each person, one Enduring Power of Attorney for Property and one Enduring Power of Attorney for Personal Care & Welfare, advice on choosing your attorneys and successor attorneys, draft documents prepared for your review, one in-person meeting to advise, witness and certify your signing, and a signed copy for your records.

Fixed Fee: $650 for one person, or $950 for a couple (including GST and standard disbursements)

For straightforward EPAs signed at our office. Fee confirmed in our Terms of Engagement after we review your information. See our Fixed fee conditions below.

Is this service right for you?

This service is suitable if you live in New Zealand, you have capacity to make your EPAs, you know who you would like as your attorneys, and you can attend our Queenstown or Cromwell office to sign. This is a fixed scope, fixed fee process. If your circumstances fall outside this scope, we can discuss tailored options.

What's not included:

Wills (see our couples Will page for the combined package), home, hospital or rest home visits, capacity assessments or medical certificates, attorneys' acceptance and certification by their own witness, EPAs involving businesses, farms or overseas assets, advance care plans, and assistance for attorneys acting under an EPA. If we identify anything outside scope after reviewing your information, we will discuss options and give you a quote before proceeding.

How it works:

Step 1: Complete the short enquiry form below to confirm suitability and agree to the fixed fee.

Step 2: Once we receive your enquiry, we run a conflict of interest check and verify your identity, as we are required to do under the Anti-Money Laundering and Countering Financing of Terrorism Act 2009. We may use RealAML, a secure electronic identity verification service, for this. We then open your file and send you our Terms of Engagement and a secure questionnaire to gather the full information we need. This is where you tell us who you would like to appoint as your attorneys.

Step 3: Once we have your full information, we prepare your draft EPAs and email them to you. You can review the drafts and tell us if anything needs to be changed or clarified.

Step 4: We meet with you in person to explain your EPAs and provide legal advice. Under the Protection of Personal and Property Rights Act 1988, your signature must be witnessed by a lawyer (or other authorised witness) who is independent of your attorneys and who certifies that they have explained the effects and implications of the EPA to you. Your attorneys then sign to accept their appointment, with their own witness.

Fixed fee conditions:

  • The fixed fee applies only to the scope of work described on this page, and only where your circumstances are straightforward.

  • Your fee is confirmed in our Terms of Engagement after we have reviewed your completed questionnaire. Submitting the enquiry form does not lock in a price.

  • If anything falls outside the scope, we will tell you and give you a revised quote before we do any extra work. Nothing extra is charged without your agreement.

  • Additional meetings, extra rounds of amendments beyond those stated, urgent turnaround, and meetings or signing outside our Queenstown or Cromwell offices (including home or hospital visits) are charged in addition.

  • Signing must be in person. Visits to your home, a hospital or rest home, or signing outside our offices are charged in addition.

  • If there is any question about capacity, we may need a medical certificate, which is not included.

  • The couple price applies where both partners sign at the same meeting.

  • EPAs pair well with a will, and we recommend reviewing your will at the same time. Wills are not included in this fee; see our Couples Wills & Enduring Powers of Attorney package.

  • The fee includes GST and standard disbursements, including electronic identity verification for the people named in the fee. Identity verification for any additional people may be charged at cost.

  • Third party costs, such as LINZ searches or registration fees, valuations and other professionals' fees, are not included.

  • The fee covers legal work only. It does not include tax, accounting or financial advice, and we recommend you speak to your accountant or financial adviser where relevant.

  • The fee is payable on invoice before or at your signing meeting, unless we agree otherwise in writing. We may ask for payment in advance.

  • Fees are current as at November 2026 and are valid for enquiries received before 31 March 2027. Prices may change after that date or if the law changes.

  • If you decide not to proceed after we have started work, we may charge for work done to that point, up to the fixed fee.

Important engagement information:

By submitting the enquiry form, you acknowledge that any engagement is subject to our Terms of Engagement, which will be provided before we begin acting for you. We may decline to accept or continue an engagement if we believe we cannot meet our professional duties, including our obligations under the Rules of Conduct and Client Care for Lawyers (RCCC). This enquiry does not create a lawyer and client relationship. Legal advice is provided at your meeting, not at the enquiry stage.
